What Are Your Rights in a Cohabitation Agreement?

In theory, your separate individual property rights in a cohabitation arrangement are stronger than if you were in a marriage. Under California law, property obtained during the course of a marriage becomes community marital property, subject to an equitable distribution in a divorce settlement. But without a legal marriage, all property is considered separate property. The only exception is if individuals can prove they have a vested interest in the property, which should then be distributed equitably.
