What is palimony?

California palimony law addresses property rights of domestic partners after a long term relationship. This type of live-in relationship with a non-marital partner used to be called a common law marriage. The State of California has not recognized common law marriage since the 1880s. For nearly one hundred years there was no legal remedy for people seeking support payments based on an oral or implied agreement with a long time partner.

In 1976 the California Supreme Court addressed the issue in the landmark palimony case: Marvin v. Marvin. The court allowed the enforcement of a verbal agreement between actor Lee Marvin and his long term live-in girlfriend, Michelle Marvin. Since then unmarried couples have been allowed to file claims seeking financial security and the enforcement of property rights based on actual or implied agreements.

Time limits
There are statutes of limitations in palimony claims. When a written agreement exists, a claim must be filed within 4 years of the end of the relationship. When the case is based on an oral agreement, the claim must be filed within 2 years.
