Palimony is not like divorce. Divorces are handled in the Family Law Courts. In a divorce case, there is an assumption that both parties share in the “community property” acquired over the duration of the marriage. Some personal property owned by the individuals prior to the marriage may be exempt from community status, but, in general, property and financial assets will be divided evenly among spouses. There are no juries in the Family Law Courts.

Palimony, on the other hand, is a litigation case, handled in the general civil courts, likely before a jury, in which none of the property is considered community property. To share in the assets after splitting with your partner requires fighting aggressively to protect your financial interests.
